Terms & Conditions

i. These terms and conditions apply to all bookings.

ii. Please read these terms and conditions carefully.

iii. All bookings made via online booking websites or with Katherine Motel directly are made subject to these terms and conditions and the person making the booking will be deemed to have accepted these Terms and Conditions on behalf of all persons who will be staying at Katherine Motel under the booking once any payment is made or intended to make in relation to the booking.

iv. These terms and conditions may relate to items such as payments, deposits and cancellations and Pet Polices.

v. If booking via your Travel Agent or any online booking source the terms and conditions provided by your Travel Agent or online booking source will apply to your booking and you should ask your Travel Agent or booking sources for a copy of these terms and conditions. To the extent of any inconsistency in which case these terms and conditions will prevail to the extent of that inconsistency.

vi. Some Terms and Conditions vary according to booking type (for example Peak Season Bookings, Non-refundable Bookings, etc.). You should ensure that you read the Terms and Conditions carefully to ensure you are aware of the Terms and Conditions which apply to your particular booking.

vii. If any part of your booking falls on a date which is classified as a Peak Season Booking date then your entire booking will be deemed a Peak Season Booking and any terms or conditions which apply to Peak Season Bookings will apply to your entire booking.

i. “Non-refundable Booking” means a booking at Katherine Motel which is advertised as a booking that has Booking Conditions that states it is a non-refundable booking.

ii. “You” and “Your” means the person who is making the booking.

iii. “Peak Season” means 1st day of March to 30th of November.

i. When you check-in you may be asked to provide photographic identification.

ii. If you are unable to provide such identification your booking may be cancelled and you may be liable to pay Katherine Motel an amount equal to the full booking amount plus any other costs incurred by Katherine Motel in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to Katherine Motel under this term.

i. Bookings can be made online via any of the online booking Websites or with Katherine Motel direct by contacting reception between 09.00 am to 06.00 pm or sending an email to reservations@katherinemotel.com.

ii. Bookings are subject to the availability and applicable pricing at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements.

iii. Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and the payment has been received and the booking has been confirmed.

iv. Any confirmed price is subject to change if:

• a payment which is due on a booking is not received by Katherine Motel by the date the payment is due; or
• there is a change in or imposition of a government charge, tax or levy which entitles or necessitates Katherine Motel changing the price of your booking.
• Any details relating to your booking are amended, for example, your dates of stay, your room type or the number of persons staying under your booking, in which case charges will apply.
• If you reasonably believe a written confirmation or invoice which has been provided to you is incorrect, you can request that Katherine Motel to reissue that written confirmation or invoice and you may either pay the amount specified on the reissued written confirmation or invoice by the date which it is specified as being due or cancel your booking.

vi. If the price of a booking is changed you may pay the new price for your booking or cancel your booking and receive a full refund according to the cancellation policy under these terms and conditions.

vii. If you make a booking via an online Website you can view details of your booking under the ‘Terms and Conditions’ area once you access the Katherine Motel website.

i. Payments may be made by Visa, Mastercard, American Express, Australian Dollar personal or bank transfer or Telegraphic Transfer (allow 7 days transaction time) for the confirmation.

ii. A non-refundable card surcharge will apply to payments made by Visa, Mastercard, American Express. The surcharge applied to these cards may vary. No surcharge will be applied to payment made through internet banking.

iii. Katherine Motel accepts no responsibility for money paid by you to a travel agency until cleared funds are received in the bank account of Katherine Motel.

i. For all the Bookings, a security deposit maximum of $500 per booking must be received immediately to confirm your booking and if the total cost of your booking is less than $200, full payment is required at the time of booking. This security deposit would be reimbursed upon check out if paid in cash in full, provided no damage is caused and the room is left with normal cleaning status and all the towels, linen, pillows, teakettle and toaster etc. remained the room as provided upon check in.

ii. For all the bookings full payment must be received at least 48 hours prior to your scheduled day of arrival or, if your booking is made within 48 hours of your scheduled day of arrival, at the time of booking.

iii. For Non-refundable Bookings full payment is required at the time of booking.

iv. If any deposit or final payment is not received by the due date, Katherine Motel reserves the right to cancel the booking and any amount paid by you in relation to your booking will be forfeited by Katherine Motel.

v. Once final payment of your booking has been made the confirmation of that payment and your booking will be sent to you via email if requested.

i. The currency applicable to any quoted rates will be specified with the quoted rate. All quoted rates are subject to change at any time until full payment is received.

ii. Quoted rates are inclusive of all compulsory government or regulatory charges and taxes (for example GST) where applicable unless it is specifically indicated.

iii. Quoted rates do not include the items of a personal nature including but not limited to laundry, telephone, taxis, room service, meals or transfers, airport taxes unless otherwise indicated.

iv. If you have been quoted a rate that includes meals and or transport you should contact at the reception to obtain details of these inclusions upon check-in.

v. Some rates which are quoted are valid only for a minimum number of nights and if the number of nights included in your booking changes the rate may also change.

vi. Please contact at the reception for information on rates for Children, Infants, extra persons and pets.

i. Refund of any amount paid by you to Katherine Motel please contact at the reception for your booking (including deposits) shall be dealt with as stated in these Terms and Conditions.

i. All amendments are subject to the availability and applicable at the time the amendment is requested.

ii. Amendments for the Bookings may be requested within 48 hours prior to your scheduled check-in time.

iii. Amendments for Peak Season Bookings may only be requested up to four days prior to your scheduled check-in time.

iv. Amendments to Non-refundable Bookings are not permitted.

v. If amendments are requested outside the time frames specified in this clause you may be charged a 100% cancellation fee in addition to the cost of your amended booking and any reduction in the amount which is payable by you in such case will be at Katherine Motel’s absolute discretion.

vi. Amendments may be requested in the following manner:

• Up to 48 hours prior to your scheduled check-in time via online booking Website or via our Reservation service or by emailing reservations@katherinemotel.com.
• Within 48 hours of your scheduled check-in time: via our Reservation service.

vii. Amendments may be requested by emailing reservations@katherinemotel.com.

viii. If the rate which applies to an amended booking is greater than the rate applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.

ix. For all Bookings, the following charges will apply to amendments requested and approved:

• Up to 48 hours prior to your scheduled check-in time: no amendment fee will apply.
• Within 48 hours of your scheduled check-in time: a $40.00 amendment fee will apply.

i. If you cancel your booking the following charges will apply in relation to each booking:

• Up to 48 hours prior to your scheduled check-in time: No cancellation fee will be applied and any deposit you have paid for your booking will be returned.
• within 48 hours of your scheduled check-in time: a 100% cancellation fee will apply, and you will be required to pay to Katherine Motel the full amount of your booking less any amount which you have already paid.

ii. If you cancel your booking in the Peak Season the following charges will apply in relation to each room, you have booked:

• Up to 7 days prior to your scheduled check-in time: No cancellation fee will be applied and any deposit you have paid for your booking will be returned.
• Within 7 days of your scheduled check-in time: a 100% cancellation fee will apply and you will be required to pay to Katherine Motel the full amount of your booking fee less any amount which you have already paid. For Non-refundable Bookings, if you cancel your booking at any time after it is made no refund of the funds paid for your booking will be made.

iii. Any cancellation fees payable by you will be deducted from any money paid by you to Katherine Motel and if insufficient funds are available Katherine Motel may charge, and you authorize Katherine Motel to charge, the credit card the details of which you provided at the time of making your booking.

iv. Where applicable the balance of any money paid by you after any applicable cancellation fee has been deducted will be held by Katherine Motel as Booking Credit which may be applied to any future bookings you make with Katherine Motel.

v. Any surcharge applied to credit cards at the time payment for the booking is made will not be refunded for non-refundable bookings.

i. If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will be required to pay to Katherine Motel the full amount of your booking less any amount which you have already paid.

ii. If you terminate your booking early and this results in your stay being less than 7 nights you will be charged the difference between the rate applied to your booking and the Best Available Rate on the Best Available Rate stayed nights.

iii. For long-term booking for 4 weeks or more, if you terminate your booking early and this results in your stay being less than 2 nights but more than 14 nights, you will be charged the difference between the rate applied to your booking as daily rates for the stayed nights. You may also be charged for any welcome or complimentary pack.

i. Standard check-in time is 2:00 pm to 6.00 pm but times may vary and you should confirm the check-in time by contacting reception or writing an email to reservations@katherinemotel.com for your scheduled check-in day.

ii. If you wish to guarantee your ability to check-in prior to 2:00 pm you must book an additional night’s stay and pay the applicable rate for that additional night/s or pay additional check-in fee subject to availability.

iii. If you would like to check-in after 6.00 pm then After Hours check-in fee may apply maximum up to AU$ 150 only subject to availability.

i. Standard check-out time is 10:00 am but times may vary and you should confirm the check-out time prior to your scheduled check-out day.

i. If you wish to check-out later than the standard check-out time you must obtain approval with the friendly staff at the reception at least an hour prior to your scheduled check-out time.

ii. The friendly staff at the reception may approve a request for late check-out in their absolute discretion.

iii. If you check-out after 10:00 am the following additional charges will be applied to your account and will be payable by you while making a request for late check out:

• if you check out before 10:30 am with prior approval no surcharge will apply;
• if you check-out between 10:00 am and 12:00 noon a surcharge of $60.00;
• if you check-out between 12:00 noon and 2:00pm a surcharge of $100.00; or
• if you check-out after 2 pm a charge equivalent to the fully daily rate which applies to your booking.

i. You must provide a credit card authorisation or imprint when you check-in you must make full payment for your booking at that time.

ii. The authorisation may be used to cover incidental items including but not limited to security bond or deposit for any breakages or loss of keys’ or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.

The pre-authorisation may also be used to settle any outstanding payments owed by you in relation to your booking including payments for the balance of your booking should you vacate the premises prior to your scheduled check-out date.

iii. The pre-authorisation process validates your credit card and protects both the cardholder and merchant from increasing fraud incidents.

iv. The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available fund’s balance or spending limit. For more information on this practice please contact your card issuer.

v. Once a pre-authorisation has been made, Katherine Motel cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer and cannot be negotiated.

vi. Where a credit card is not available a cash security deposit maximum of $500 required on check-in.

vii. If any damages are done to the property by the guest and/or their visitors/friends/ relatives, then the guest and/or the person who made the booking will be liable to pay damage cost along with the compensation.

i. In the unlikely event that Katherine Motel cannot provide accommodation at the Property for which you have booked, Katherine Motel will at no additional expense to you relocate you into an alternative property which in the reasonable opinion of Katherine Motel is of comparable quality and in a comparable location at Katherine NT.

ii. If a property of comparable quality in a comparable location is not available, Katherine Motel may relocate you to a property of less comparable quality or less comparable location in which case Katherine Motel will pay you an amount that it reasonably believes represents the difference between the rate payable for the alternate property and the rate paid by you for the Katherine Motel, which you had booked.

iii. Should you wish to be relocated to an alternative property other than the property chosen by Katherine Motel under this term, you will be required to pay any difference in price between Katherine Motel’s choice of property and your chosen property.

iv. If you and Katherine Motel cannot agree on an alternative property under this clause then you may request Katherine Motel cancel your booking and issue you with a Booking Credit for the full amount of that booking less any amounts which you owe to Katherine Motel.

v. If you and Katherine Motel cannot agree on an alternative property under this clause and you do not wish to be issued a Booking Credit then you may request that Katherine Motel cancel your booking and provide you with a refund for the full amount of that booking less any amounts which you owe to Katherine Motel.

i. If your booking does not include room servicing unless your stay is for eight (8) nights or more in which case your room will be serviced on the fourth (4th) day of your stay.

ii. If your booking is for less than EIGHT nights, your booking may not include room servicing or may include a daily or weekly room servicing depending on the rate which has been quoted and you should confirm at the time of your booking whether your booking includes room servicing.

iii. If your booking does not include room servicing a ‘Refresh’ service is available for separate purchase for room amenities’.

iv. You can inquire about this ‘Refresh’ service when you check in to the Property.

v. Additional room services can be arranged, and charges will apply.

i. Infants sharing a room with their parents or guardians may do so free of charge if using existing beds and linen and not exceeding the maximum occupancy for the given room type.

ii. Children and Infants may not stay in any room without an Adult.

iii. Additional charges will apply if extra beds or linen are required. These are charged at the extra person rate. Extra-person rates $35 per person, per night will be charged on a Room Only basis unless otherwise stated.

i. Persons aged over 12 years will be charged Extra Person rates for each person staying in a room which exceeds the maximum occupancy for the room type, or where extra beds or linen are required.

ii. Extra-person room rates will be charged on a Room Only basis unless otherwise stated.

i. Only the guests’ registered at the reception records of the Katherine Motel is/ are the authorized person.

ii. Trespass involves entering and/ or remaining in the Katherine Motel boundaries’ knowing one is on this premises without a privilege.

iii. A person not lawfully authorized to stay or enter on the premises of KATHERINE MOTEL is the offender/ trespasser, may be prosecuted under Civil Law and/ or Criminal Code Act.

i. Within the boundaries of the Katherine Motel all pets must be pre-approved by the incharge at the reception and an extra fee of $50 per pet, per night to be paid before check-in.

ii. Only our STANDARD ROOMS are Pet friendly so we must be aware of the pet/s for the purpose of room allocation.

iii. For the safety of all guests, pets are NOT PERMITTED OFF-LEASH within the property at any of the time.

iv. Pets are NOT PERMITTED in the POOL, LAUNDRY AND KITCHEN AREAS.

v. NON- DECLARATION OF PET will be charged for $500.

vi. Guests are responsible for cleaning up after their pet on motel property.

vii. Guests are responsible for all property damages and/or personal injuries resulting from their pet.

viii. KATHERINE MOTEL reserves the right to charge guest’s account commensurate to the cost of such damages.

i. Whilst care is taken to ensure that the description of facilities and services of the Katherine Motel is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature/facility is essential to you in booking with Katherine Motel, it is your responsibility to confirm with the property prior to making your booking that the feature/facility will be available during your stay.

ii. To the extent permitted by law, Katherine Motel is not liable for omissions, errors or changes to the facilities and services at the property, whether temporary or permanent.

iii. Accommodation facilities listed may not apply to all room types.

i. Whilst Katherine Motel attempts to satisfy all special requests, Katherine Motel does not guarantee that special requests can be accommodated.

i. Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.

ii. Destination shots may have been supplied to Katherine Motel by third parties and Katherine Motel does not guarantee the accuracy of any destination shots.

iii. Photos and floor plans are indicative only. Actual rooms occupied may vary in decor and inclusions from those shown.

25.1 Application of this Clause

This Clause applies to every person who enters, visits or uses any part of Katherine Motel, including without limitation:

• accommodation guests;
• day visitors;
• patrons of the restaurant;
• patrons of Bhoj Coffee Shop & Restaurant;
• patrons of the bar;
• conference, meeting, training and function attendees;
• event organisers;
• contractors, suppliers and delivery personnel;
• invitees and visitors of guests; and
• any other person lawfully present on the Katherine Motel premises (collectively referred to as "Guests and Visitors").

This Clause applies to all areas of Katherine Motel, including without limitation:

• guest accommodation;
• reception;
• restaurant;
• Bhoj Coffee Shop & Restaurant;
• bar;
• conference and training rooms;
• meeting rooms;
• function areas;
• gardens;
• walkways;
• driveways;
• car parks;
• outdoor areas; and
• every other part of the Katherine Motel property.

25.2 Recommendation to Obtain Insurance

Katherine Motel strongly recommends that all Guests and Visitors obtain and maintain comprehensive travel, personal and public liability insurance where appropriate, covering their attendance at Katherine Motel.

Such insurance should include, without limitation:

• cancellation or interruption of travel;
• medical and hospital expenses;
• ambulance expenses;
• personal injury;
• illness;
• disability;
• death;
• theft, loss or damage to luggage and personal property;
• loss or damage to cash and valuables;
• laptops, mobile phones and electronic devices;
• business equipment;
• all motor vehicles, motorcycles, caravans, trailers and bicycles;
• legal liability to third parties; and
• any direct, indirect or consequential financial loss.

25.3 Guest Responsibility

By making a booking, purchasing goods or services, attending an event, entering, visiting, dining, consuming food or beverages, using the restaurant, Bhoj Coffee Shop & Restaurant, bar, conference or training facilities, parking a vehicle, or otherwise remaining on Katherine Motel property, every Guest and Visitor acknowledges and agrees that:

• they are solely responsible for their own safety and the safety of persons accompanying them;
• they are solely responsible for obtaining any insurance they consider necessary;
• Katherine Motel does not provide insurance for any Guest or Visitor;
• Katherine Motel is not responsible for any uninsured loss suffered by a Guest or Visitor;
• they assume all risks associated with their attendance at, or use of, any Katherine Motel facilities; and
• this Clause forms part of the contractual terms governing entry onto the Katherine Motel premises, whether or not accommodation has been booked.

25.4 Vehicles, Personal Property, Personal Injury, Release and Limitation of Liability

The provisions of this Clause apply equally to all Guests and Visitors using any part of Katherine Motel, including accommodation, the restaurant, Bhoj Coffee Shop & Restaurant, the bar, conference and training facilities, function rooms, reception, car parks and all common areas.

To the fullest extent permitted by law, Katherine Motel shall not be liable for:

• theft, loss of or damage to any vehicle;
• theft, loss of or damage to any personal belongings or valuables;
• personal injury, illness, disease, allergic reaction or death;
• slips, trips or falls;
• food or beverage consumption except where liability cannot legally be excluded;
• acts or omissions of other Guests or Visitors;
• interruption of conferences, meetings or events;
• business interruption or loss of commercial opportunity.

i. All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian, or another adult who has parental rights and responsibilities for the under-18-year-old guest.

ii. If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult. Katherine Motel may immediately cancel the guest’s booking and the full booking amount will be forfeited to Katherine Motel under this clause.

i. Third-party products or services are sometimes sold together with accommodation provided by Katherine Motel. In such circumstances, the third party is entirely responsible for supplying the products or services to you and any involvement Katherine Motel has in facilitating your booking with the third party is as the third party’s agent. Katherine Motel is in no way the supplier of the products and services and to the extent permitted by law, Katherine Motel is not liable for any failure by the third party to provide the products or services, nor for any act, error, omission, default or negligence of the third party.

ii. All third party coupons, vouchers, invoices, receipts and tickets are issued subject to the terms and conditions specified by those third parties.

iii. Katherine Motel does not warrant the accuracy of any information, statements or representations made by third parties.

i. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Katherine Motel are excluded under these Terms and Conditions.

ii. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Katherine Motel to limit its liability, then Katherine Motel’s liability is limited to:

• In the case of services, supplying the services again or payment of the cost of having the services supplied again; and
• In the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

iii. To the extent permitted by law the aggregate of Katherine Motel’s liability to you is limited to an amount not exceeding the amount paid by you for your booking.

iv. Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

i. Katherine Motel is not responsible for any loss arising out of any occurrences or conditions or wifi connectivities beyond its control, including but not limited to acts of terrorism, the act of God, defects in vehicles, technical fault of any equipment and or services, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.

ii. All travel documents, observance of laws and government regulations are your responsibility.

i. You consent and authorise Katherine Motel to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.

ii. You consent to information which you have provided to Katherine Motel as part of your booking being used by Katherine Motel or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate Katherine Motel.

iii. Upon request by you and to the extent permitted or required by law, Katherine Motel will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

i. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Northern Territory, Australia.

ii. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
